These Terms & Conditions govern your access to and purchases from ecomgrove.in, operated by ECOMGROVE (OPC) PRIVATE LIMITED (“ECOMGROVE”, “we”, “us” or “our”), GSTIN: 10AAJCE2145G1Z6, having its address at C/O Jitendra Pandit (S/o Dudheshwar Pandit), Eshwar Pandit Sipah Panch, Sipah Arwal, Arwal, Bihar – 804401. By using this website or placing an order, you agree to these Terms.
1. Eligibility and Accounts
You must be legally capable of entering into a contract under Indian law. You are responsible for providing complete and accurate information, maintaining the confidentiality of your account credentials and all activity conducted through your account. Please notify us promptly if you suspect unauthorised use.
2. Products and Product Information
We sell jewellery and related products. We make reasonable efforts to display product descriptions, materials, dimensions, prices and colours accurately. However, colours may vary depending on your device, and minor manufacturing or design variations may occur. Product images are for illustration purposes.
3. Prices, GST and Other Charges
All prices are displayed in Indian Rupees (INR). Applicable taxes, shipping charges and any other charges will be displayed before the order is confirmed. We may change prices prospectively.
If a material pricing or listing error affects your order, we may contact you to confirm the corrected price or cancel the order. If the order is cancelled after payment, the full amount collected will be refunded to the original payment method.
4. Order Placement and Acceptance
An order acknowledgement only confirms that we have received your order request; it does not constitute final acceptance. An order is accepted when we confirm dispatch or otherwise expressly confirm acceptance.
Order acceptance is subject to product availability, successful payment authorisation, delivery serviceability and fraud-prevention checks. We may reject or cancel an order for lawful reasons and will promptly refund any payment collected for a cancelled order.
5. Payment
Payment may be made using the methods displayed at checkout, including eligible cards, UPI, net banking or other available methods. Payment information is processed securely by authorised payment service providers. We do not intentionally store complete card details.
6. Order Cancellation
You may request cancellation before the order is dispatched, as described in our Cancellation Policy. Eligible prepaid order cancellations will be refunded in full to the original payment method.
Once an order has been dispatched, it cannot normally be cancelled. You may request a return after delivery in accordance with our Refund & Returns Policy.
7. Shipping and Delivery
We deliver to serviceable locations in India in accordance with our Shipping & Delivery Policy. Delivery dates are estimates and may be affected by carrier delays, public holidays, incorrect addresses or events beyond our reasonable control.
Please provide a complete and accurate delivery address and ensure that someone is available to receive the order.
8. Returns, Exchanges and Refunds
Returns, exchanges, inspection requirements, exclusions and refund timelines are governed by our Refund & Returns Policy.
Nothing in these Terms excludes a remedy that must be provided where a product is defective, damaged, incorrect, materially different from its description or otherwise covered by applicable consumer law.
9. Product Availability and Listing Errors
All products are subject to availability. We may limit quantities or discontinue products. If a product becomes unavailable after payment, we will notify you and issue a full refund for the unavailable product.
10. User Conduct and Fraud Prevention
You must not misuse the website, submit false information, interfere with website security, attempt unauthorised access, infringe the rights of others or place fraudulent orders.
We may suspend access, cancel affected orders and cooperate with lawful investigations where fraudulent, abusive or unlawful activity is reasonably suspected.
11. Intellectual Property
The website, brand name, photographs, graphics, text and other content are owned by or licensed to ECOMGROVE and are protected under applicable intellectual-property laws.
You may use the website for personal and non-commercial shopping purposes. You may not copy, modify, republish, distribute or commercially exploit website content without our prior written permission, except where permitted by law.
12. Third-Party Services and Links
Payment, delivery and other services may be provided by third parties under their own terms. Links to external websites are provided for convenience. We are not responsible for third-party content or conduct outside our control, except where liability cannot lawfully be excluded.
13. Limitation of Liability
To the maximum extent permitted by law, ECOMGROVE will not be liable for indirect or consequential losses arising from use of the website. Our liability relating to a product will not exceed the amount paid for that product, except where applicable law requires otherwise.
Nothing in these Terms limits liability for fraud, wilful misconduct, personal injury caused by negligence or any mandatory consumer right.
14. Consumer Rights
Nothing in these Terms limits or excludes rights available to consumers under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020 or any other applicable law.
15. Privacy
Personal data is collected and handled in accordance with our Privacy Policy.
16. Changes to These Terms
We may update these Terms prospectively. The version displayed when an order is placed will ordinarily govern that order, unless a change is required by law. Material changes will be posted on this page with an updated revision date.
17. Governing Law and Disputes
These Terms are governed by the laws of India. Subject to applicable consumer-protection laws and any forum available to consumers by law, courts having jurisdiction in Bihar shall have jurisdiction.
Nothing in these Terms restricts your right to approach a consumer commission or any other grievance or dispute-resolution forum available under applicable law.
